As part of a major European project of publishing four volumes of the Commentary of the Treaty on the Functioning of the European Union (TFEU), the Springer First Online has published the commentaries of Articles 116 and 117, written by Uroš Ćemalović, senior research associate of the Institute of European Studies.
More than 100 experts in different legal fields (professors, judges, scientists and practitioners) participate in this project, almost all of whom are from EU member states. The Commentary of the TFEU presents detailed explanations, article by article, of all the provisions of the TFEU, discussing the application of Union law in the national legal orders and its interpretation by the Court of Justice of the EU. The first volume, which includes the commentaries of Articles 1-89, has already been published (ed. Hermann-Josef Blanke, Stelio Mangiameli, Springer, 2021), while the second volume, which includes two chapters written by Uroš Ćemalović, will be published in the second half of 2023.
Article 116 of the TFEU lays down rules on the adoption of EU directives harmonising the legislation of member states when a difference between national provisions in Member States is distorting the conditions of competition in the internal market https://link.springer.com/chapter/10.1007/16559_2023_67.
Article 117 of the TFEU is designed to introduce the procedure for the adoption of national measures in the Member States, on the proposal of the European Commission, aiming to prevent a distortion of the conditions of competition in the internal market https://link.springer.com/chapter/10.1007/16559_2023_68.
